General terms and conditions
Article 1 - Definitions

In these terms and conditions, the following definitions shall apply

Withdrawal period: the period during which the consumer may exercise his right of withdrawal;
Consumer: the natural person who is not acting in the exercise of a profession or business and who concludes a distance contract with the contractor;
Day: calendar day;
Transaction of duration: a distance contract for a series of products and/or services, the delivery and/or purchase obligation of which is spread over time;
Durable data medium: any means enabling the consumer or entrepreneur to store information addressed personally to him, in a way that allows future consultation and unchanged reproduction of the stored information.
Right of withdrawal: the possibility for the consumer to cancel the distance contract during the withdrawal period;
Contractor: the natural or legal person who offers products and/or services to consumers at a distance;
Distance contract: a contract in which, as part of a system organized by the contractor for the distance sale of products and/or services, exclusive use is made of one or more distance communication techniques until the contract is concluded;
Remote communication technique: any means that can be used to conclude a contract without the consumer and the contractor being simultaneously present in the same space.

Article 3 - Applicability

These general terms and conditions apply to any offer made by the contractor and to any distance contract concluded between the contractor and the consumer.

Prior to the conclusion of the distance contract, the text of these general terms and conditions shall be made available to the consumer. If it is not reasonably possible to do so, it will be indicated before the conclusion of the distance contract that the general terms and conditions can be consulted at the contractor's premises and that they will be sent to the consumer free of charge on request.

If the distance contract is concluded electronically, the text of these general terms and conditions may, in derogation of the preceding paragraph and prior to the conclusion of the distance contract, be made available to the consumer electronically in such a way that the consumer can easily store it on a durable data medium.

Where, in addition to these general terms and conditions, specific terms and conditions relating to products or services apply, the consumer may always rely on the provision which is most favourable to him in the event of conflicting terms and conditions.

If one or more provisions of these general terms and conditions are invalid or cancelled at any time, the contract and these conditions remain valid for the remainder, and the provision in question will be replaced by a provision that comes as close as possible to the original.

Situations not provided for in these terms and conditions are to be assessed “in the spirit” of these terms and conditions.

Any ambiguity as to the interpretation or content of one or more provisions of these terms and conditions shall be interpreted “in the spirit” of these terms and conditions.

Article 4 - The offer

If an offer has a limited validity period or is subject to conditions, this will be expressly indicated in the offer.

The offer is non-binding. The contractor is entitled to modify and adapt the offer.

The offer contains a complete and accurate description of the products and/or services offered. The description is sufficiently detailed to enable a correct assessment of the offer by the consumer.

All images, specifications and data in the offer are indicative and may not give rise to compensation or termination of the contract.

Each offer contains clear information enabling the consumer to know his rights and obligations linked to the acceptance of the offer, in particular:

The price, excluding customs clearance costs and import VAT. These additional charges will be borne by the customer and collected by the postal service or carrier.
Any shipping costs;
The manner in which the contract will be concluded and the actions required to this end;
Whether or not the right of withdrawal applies;
Methods of payment, delivery and performance of the contract;
The period during which the offer must be accepted, or the period during which the price is guaranteed by the contractor;
The possibility for the consumer to check and correct the data entered before concluding the contract;
Any other languages in which the contract may be concluded in addition to French;
The codes of conduct to which the contractor has subscribed, and the way in which the consumer can consult them electronically;
The minimum duration of the distance contract in the event of a time-limited transaction.
Article 5 - The contract

Subject to the provisions of paragraph 4, the contract is concluded when the consumer accepts the offer and complies with the associated conditions.

If the consumer has accepted the offer electronically, the contractor shall immediately confirm receipt of the electronic acceptance of the offer. Until such receipt has been confirmed, the consumer may withdraw from the contract.

If the contract is concluded electronically, the contractor takes appropriate technical and organizational measures to secure electronic data transmission and ensures a secure web environment.

The contractor may inquire, within the legal limits, about the consumer's ability to meet his payment obligations, as well as about all facts and factors important for a responsible conclusion of the distance contract.

The contractor shall provide the consumer with the following information in writing or on a durable data carrier:

The address of the contractor's place of business where the consumer can address any complaints;
The terms and conditions for exercising the right of withdrawal;
Information on guarantees and after-sales service;
Requirements for terminating the contract if it is for more than one year or is open-ended.
Each contract is concluded under the suspensive condition of sufficient availability of the products concerned.
